In accordance with the WTitten Agreement dated as of Oct. 24, 1997, between the Silverstein Properties, Inc and the Architect, Swanke Hayden Connell & Partners LLP, for the following Project. Major’s Office of Emergency Management (OEM) Emergency Operations Center: 7*World Trade Center NY, NY

The Owner agrees and hereby authorizes Swanke Hayden Connell & Partners to _X_ Proceed with Additional Services X Prtxieed with revised Scope of Services X Incur Out-of-Pocket Expenses

As follows. OEM/DCAS requests scope revisions per OEM's fax dated 11/06/98 and verbal instructions provided by DCAS at the 11 /05'98 Audio-Visual meeting in reference to the following scope changes: 1.) Graphic design and location o±' the OEM logo to be placed on the EOC podium. Press Room and the Reception Area; and 2.) New storage closet and revised millwoik for die First Deputy’s Office (23-09), Sketches will not be issued to the Port Authority at this time. Should the project need to be re-filed with the Port Authority, the fees and out-of-pocket expenses associated with this submission will be an additional service. Please note that printing costs associated with graphic design services are generally higher than normal.

Compensation to the .Arch tect shall be adjusted as follows: Fee: $ 2,375 Out-of Pocket Expenses ■ S 470 (Not-to-Exceed) Time for performance shall be adjusted as follows: N/A Upon return of a fully executed authorization, this service shall become part of the Agreement identified above. In the event that, after transmittal of this Agreement to the 'Jwner, payments to the Architect are made by the Owner after perfonnance of any of the services called for herein, the Owner will be deemed to have accepted all terms of the Agreement not otherwise objected to.
