Here are a few comments on EPA's draft of the Request Form for the Indoor Air Program: Steve and I both found the two choices put to the tenant/owners on page 1 to be somewhat confusing. Except for the distinction drawn between the “aggressive” and “modifed aggressive” air sampling on the last page, there is little explanation of what air sampling consists of, and there is no explanation at all of what “monitoring” is. It’s unclear whether this form will be distributed together with another document that will explain the program, but if not, the program and these terms should be explained in the Request Form. If there is a separate document explaining the program and these terms, the other document should be referenced in the Form in a way that makes it clear that the tenant/owner understands what it is he/she is consenting to. Also, if the tenant/owner requests “monitoring of the Residence” (second of the first two choices on page 1), I suppose what’s intended is that the tenant/owner will decide whether he/she wants to request dust cleaning after seeing the results of the monitoring. The second choice should probably say, therefore: “I request monitoring of the Residence. 1 will wait until 1 see the results of the monitoring before deciding whether to request dust cleaning of the Residence.” The purpose of the air sampling should be made clear. (For comparison, see the first of the two choices on page 1 - monitoring afterwards will be to confirm that asbestos is not present above cleanup levels.) Unless all monitoring/sampling/cleaning will happen on a single day, the form should specify the length of time for which consent to access the residence is given (see last para., page 1), or at least make clear that the tenant/owner understands the various steps entailed and that it will take a number of days to complete the various processes. Page 2,3'^ paragraph, 2'«’ line - change “and fragile objects” to “and fragile and valuable objects”. Everything else in the Form seems ok. The proposed addendum to the contract, responding to EPA’s request for changes to the contract, also seems ok. Please call if you’d like to discuss.
