i received two e-mails regarding the 114 Liberty St. scope of work. I responded to the first (copies forwarded to you ), since what they received was not my report (I haven’t written the report yet). I wanted to make sure it was understood.

The information in this one is not correct either.

Do you want me to respond or wait for the written comments on this one? Briefly, We did not perform demolition at 125 Cedar, we lifted buckled floors and cut away sheet rock with mold growth. The removal of drop ceiling tiles is part of our asbestos rules and is based on the porous nature of the tiles and the ability to clean them, not on the ease of doing the work. I am not sure what they are asking for with the contractor selection and our scope, but I made it clear that we cannot control which contractor gets the work. It seems they want us to spec the entire project and then just do our portion.

Penny, Thanks for the information. We will work on it and return it to you. We are also producing our own spec for our building based on standards that we consider critical to our long term safety. We will send those to you when we have completed them. As for the situation on our building, I understand that you and others at the DEP are considering our requests to take responsibility for demolition and waste removal prior to cleaning. I understand that you have previously performed demolition at 125 Cedar to deal with mold. In our case, the demolition is intended to deal with the contaminated WTC dust which we know to be behind our walls and in our ceilings. 1 know you have also agreed to remove the dropped/tiled ceilings in the commercial space. Again, we believe that our residential ceilings are identical in terms of contamination to those dropped ceilings. The only difference is that the residential ceilings take more work to remove than tiled ceilings. My understanding is that the project is meant to decontaminate our building and procedures will be based on action necessary to complete the decontamination. We hope you will positively consider our requests to fully support the decontamination of our building. We are working with Treo to get estimates for the full scope of work on our building. We understand that once you produce a final spec, it will go to an open bid through a formal process. I think it is important to understand that your contractors (at least some of them) are fully equipped and capable 1
