December 17, 2002 114 LIBERTY STREET REMOVAL OF DUST, DEBRIS, AND CONTAMINATED MATERIALS
25. Industrial Hygiene: shall mean that science and art devoted to the recognition, evaluation, and control of those environmental factors or stresses, arising in or from the work place, which may cause sickness, impaired health and well being, or significant discomfort and inefficiency among worker or among the citizens of the community.
26. Industrial Hygienist: shall mean an individual having a college or university degree or degrees in Engineering, Chemistry, Physics or Medicine, or related Biological Sciences who, by virtue of special studies and training, has acquired competence in industrial hygiene. Such special studies and training must have been sufficient in all of the above cognate sciences to provide the abilities:
a) To recognize the environmental factors and to understand their effect on people and their well being; and
b) To evaluate, on the basis of experience and with the aid of quantitative measurement techniques, the magnitude of these stresses in terms of ability to impair people's health and well being; and
c) To prescribe methods to eliminate, control, or reduce such stresses when necessary to alleviate their efforts.
27. MSHA: shall mean the Mine Safety and Health Administration, Approval and Certification Center, PC Box 251, Route 1, Philadelphia, VW 26059.
28. Negative Air Pressure Eguipment shall mean a portable local exhaust system equipped with HEPA filtration. The system shall be capable of creating a negative pressure differential between the outside and inside of the work area.
29. NIOSH: shall mean the National Institute for Occupational Safety and Health ODO - NIOSH, 4676 Columbia Parkway, Cincinnati, OH 45226.
30. Occupied Area: shall mean an area of the worksite where abatement is not taking place and where personnel or occupants normally function or where workers are not required to use personal protective equipment.
31. OSHA: shall mean the Occupational Safety and Health Administration, 200 Constitution Avenue NW, Washington DC 20210.
32. Person: shall mean any individual, partnership, company, corporation, association, firm, organization, governmental agency, administration, or department, or any other group of individuals, or any officer or employee thereof.
33. Personal Protective Eguipment (PPE): shall mean appropriate protective clothing, gloves, eye protection, footwear, head gear, and approved respiratory protection acceptable to the Department.
34. Physician: shall mean a person licensed or otherwise authorized under Article 131 Section 65.22 of the New York State Education Law.
