Mr. Paul Magda Bankers Trust Company Corporate Real Estate & Services Deutsche Bank 14 Wall Street New York, New York 10005

Dear Mr. Magda;

The NYC DDC is in the process of completing fire demobilization of the demolition and recovery project at the World Trade Center. This includes the removal of the sidewalk shed along Liberty Street, portions of which fi-ont on your building on Liberty Street

The maintenance of a sidewalk shed in front of your particular building may still be required and as the building was returned to your responsibility you must perform the necessary evaluations to determine if this is the case. Should it be determined, by appropriate analysis, that a sidewalk shed must be maintained it must be at your sole responsibility and expense.

The current schedule for removal of die Liberty Street sidewalk shed is to commence August 15,2002 and be convicted no later than August 30,2002.

The Mayor’s Office of Emergency Management (OEM) has been acting as liaison with building owners in an effort to insure overall coordination of demobilization, along with the DDC.

It may be possible to assign existing scaffolding agreements directly to private building owners if necessary, but this must be immediately coordinated due to the schedule, if building scaffolding, under your control, exists above and/or is supported by DDC’s shed, it must be removed prior to our removal, or you must arrange for contractual assignment to you of that portion of the shed.

Please prepare a written response to the aforementioned plan and DDC, John Mason at (212) 640-9045.

DDC/OEM will proceed as planned unless notified in writing to the contrary.
