NYC 9/11 Public Portal Document NYC-DEP Information For Bidders and Supply & Service Agreement (Rev. 11/93) of its execution. 12. “FINAL ACCEPTANCE" shail mean final acceptance of the work by the Commissioner as evidenced by his signature upon his certificate of completion and acceptance filed in the Office of the Comprroller, copy of which shall be semt to the Contractor. Such acceptance shall be deemed to have taken place as the date so stated in such certificate. 13. "LAW" or “LAWS" shall mean the Constinution of the State of New York, the New York City Charter, the New York City Administrative Code, a stature of the United States or of the State of New York, 2 local law of the City of New York, and any ordimance, rule or reguiation having the force of law. 14. “MATERIALMAN” shall mean any person, firm or corporation, other than employees of the Contractor, who or which contracts with the Contractor, or any subcontractor to fabricate or deliver, or who actually fabricates or delivers, plant, materiais or equipment to be incorporated in the work. 15. °OTHER CONTRACTORS" shall mean any Contractor {other than the party of the second part or his subcontractors) who has a contract with the City for work on or adjacent to the buiiding or sites of the work. 16. “PROJECT™ shall mean the public improvement to which this contract relates. 17. “PROJECT MANAGER" shall mean the representative of the Commissioner duly designated by him to be his representative at the site of work. 18. "REQUIRED QUANTITY™ im a umit price contract shall mean the actual quantity of any itern of work or materials which is required to be performed or furnished in order to comply with the contract. . 19. | “SITE” shall mean the area upon or in which the Contractor’s operations are carried on, and such other areas adjacent thereto as may be designated as such by the Project Manager. 20. “SPECIFICATIONS” shall mean all of the directions, requirements and standards of performance applying to the work as hereinafter detailed and designated under specifications. 21. “SUBCONTRACTOR” shall mean any person, firm or corporation, other than employees of the Contractor, who or which contracts with the Contractor or his subcontractors to furnish, or actually furnishes labor, or iabor and materials, or labor and equipment, at the site. 22. “TREASURER shail mean the Finance Administrator of the City of New York. 23. “THE WORK" shall mean everything required to be furnished and done by the Contractor under the contract, and shall inchude both comtract work and extra work. 14 NYC-WTC_000154145
