NYC 9/11 Public Portal Document RYC—-DEP Information For Bidders and Supply & Service Agreement (Rev. 11/93) : ARTICLE 2 - DEFINITIONS The following words and expressions, or pronouns used in their stead, shall, wherever they appear in this contract, be construed as follows, unless a different meaning is clear from the context: 1. "ADDENDUM" or "ADDENDA" shall mean the additional contract provisions issued 2. “AGENCY” shail mean a city, county, borough or other office, position, department, division, bureau, board or a corporation, institution or agency of government, the expenses of which are paid in whole or in part from the City treasury. 3. “*CITY™ shall mean the City of New York, party of the first part. 4. “COMMISSIONER (or AGENCY HEAD)" _ shall the Commissioner of Environmental Protection of the City of New York, or his duly authorized representative designated in writing by the Commissioner. 5. “COMPTROLLER” shall mean the Comprrolier of the City of New York. 6. "“CONTRACT™ or “CONTRACT DOCUMENTS" shall mean each of the various parts of the contract referred to in Article 1 hereof, both as a whole and severally. 7. “CONTRACTOR* shall mean the party of the second part hereto, whether corporation, firm or individual, or any combination thereof, and its, their or his successors, personal or which shall at any tirne be substinited in the place of the party of the second part under this contract. 8. "CONTRACT DRAWINGS" shall mean only those drawings specifically entitled as such and listed in the specifications or in any addendum, or any detailed drawings furnished by the 9. “CONTRACT WORK" shail mean everything required to be furnished and done by the Contractor by any one or more of the parts of the contract referred to im Article 1 hereof, except extra work as hereiafter defined: it bemg understood that, in case of any imconsistency m or between any part or parts of this contract, the Project Manager shall determine which shall prevail. 10. “DEPARTMENT™ shall mean the Department of Environmental Protection of the City of New York actmg by and through the Commissioner thereof, or his duly authorized representative. ii. “EXTRA WORK” shall mean work other than that required by the contract at the time 13 NYC-WTC_000154144
