Any discovery at inveatian arising out of a* developed in die course of performance of dus Agreement shall be proopdy and fully repCTted to the D^jartment, and if this work is sapponed. by a federal grant of fix^. it shall be prongstly and fully tepaned to die Federal Government iar daennination as to whether patent jataectian on such invention shall be sought and how die rights in the invention or disc^ery, wHarfwig rights under any patent issued diereai. shall be disposed of and admimstered in mder to protect die public interest.

C. If any copyrightable material is developed under, or in die course of performing this Agreement, any Federal Agency providing federal financial pardcipaxion for the Agreement shall have a royalty fee. non exclusive and irrevocable right to reproduce, publish or otherwise use. and to authorize others to use, the work for governmental.purposes.

D. In no event shall Subsections A, B, and C of this Section be deemed to apply to any report, doctnnent or other data, or any inventian of die Ccmtractor which existed prior to. or was developed or discovered independently from, its activities related to or funded by this Agreement.

12.12 ANTITRUST The Contractor hereby assigns, sells, and iransfers-to the Chy all right, titie and interest in and to any ciaims and causes of action arising under die anti trust laws of die State of New York or of the United States relating to the particular goods or services purchased or procured by the City under this Agreement.

12.13 POLITICAL ACnSTTY A. There shall be no partisan political activity or any activity to furrier die election or defeat of any candidate for public, political or party office as part of or in connection with
