This is to confirm our recent telephone conversation regarding the cleaning activities at 125 Cedar Street and specifically the firebrick in your apartment.

The NYC Department of Environmental Protection (DEP) in conjunction with the United States Environmental Protection Agency (EPA) developed a site-specific Scope of Work and environmental sampling plan for 125 Cedar Street. This plan was developed over the summer of2002 and included input from both the building owner and tenants of 125 Cedar, as well as the agencies mentioned above. The cleaning activities were to be performed by a certified asbestos contractor. Sampling and air monitoring were to be conducted by a licensed air monitoring company and all samples were to be analyzed by a New York State accredited lab. As you know, the monitoring and cleanup activities started on September 12, 2002.

The Scope of Work did not include coating or encapsulating any surfaces prior to the performance of environmental sampling. DEP did ensure that the firebricks in your apartment were appropriately cleaned prior to any final environmental sampling.

Based on your request in late August for the sealing of said firebricks, DEP staff contacted Samson Management to ascertain if this request was something that they might undertake, since it was not required in the Scope of Work. Mr. Joseph Masino of Samson Management indicated at that time that his company would undertake this task after the environmental sampling was performed.
