This letter is a foUow-up to the Lafcor-Macagemeci meeting held this past
Monday morning et 33 Beaver Street, wherein Bernard McSorlej' I respectively
represented Loci 237 and its aflUiatethe Civil Service Bar Association, Dennis Sullivan
and Lee Clarke, among others, represented Dierdct Counsel 37, Richard Yates
repreaested rhe Cisy’s Office of l abor ReiStif^ns, Vincent D'Otazio represented
Cotporailon Counsel, and Eltzabci TnuoGut, Joseph Wagner, Lori Fiexsteiu, Mitchell
Paluszek and yourself wprerented OCAS aadZor COSH,
At that time, Joseph Wagner, PE, represented that all occupied city owned or
leased bidldlngs in lower Manhattan have been inspected subsequent to the September
11World Trade Center tragedy, end have been eerdfied as structuraliy sound. Richard
Yates and yourself rated that tie air qual tv was tested and deemed safe within all these
facilities. You distrihuled a two page '’Status of Owaed/Loased City Frqrerties as of
10/01/01’* spread sheet punioning to show, among other dtings. which buildings have
been reopeced. have been eertified as strucmrally sound, have been cleaned, have had
their interior surfaces tested for eootamiaants. the ahbome asbestos testing results.
Despite die above assurances, thia union and its membcisldp remain concerned
about both foe shon and long-tenn health and safey consequences ofbeing in thb
environment. For example, both the airborne end surfiice lesiing, upon iuformstion and
belief, WM conducted solely on one occasion per location. As foe icMvery operstion
coatiaues at "Ground Z<o'‘, terrible odors ate often smelled both inside and outside of
many* buildings downtown. Since winds and air currents shift it may well be foa;
"negative'’ or “safe'* test results taken on a particular day and time could change. We
