Dear Commissioner Miele,
We respectfully request that your office issue a letter confirming the appropriateness of the steps
that we as owners of the above building have taken to address air quality concerns of our
residents in the shadow of the September 11s' attacks. Your letter will help put our residents at
ease. We believe that we have not only strictly satisfied all regulatory obligations, but have also
gone beyond our legal obligations to help provide comfort to the many residents who have
ongoing questions.
Individual residents, the New York Environmental Law & Justice Project (NYELIP), and
Channel 4 News have all mischaracterized the air quality in the building in the last few days.
They have indicated that the building has a "high concentration of asbestos contamination" and
by questioning DEP approved testing methods on the basis of a single ASTM 5755-95 surface
sample performed by Ed Olmsted, CIH, CS? for Mr. Joel Kupferman, Esq., Executive Director of
NYEIJP.
The building facts follow:
• There was no indication of dust accumulations inside the building in the days after September
110i.
In order to put residents at ease we have:
• Hired ATC Associates as our environmental consulting firm.
• Provided extensive written updates to every resident dated October 19th, 29th and 31st,
November 28th, and December 130i. Note the sections on Air Quality in every update that
fully describe the commitments we have made and met.
• Provided a booklet of air quality information to all residents that included documents and
web information from EPA and NYCDOH.
• Had all the hallways and common areas cleaned using wet methods and hepa vacuums
according to a protocol established by ATC and supervised by ATC.
• Had all the common area hvac equipment cleaned and filters replaced before they were
restarted after September l 1th, and upgraded the filters as to filtration efficiency
• Ordered and installed (as received) new custom-made higher efficiency filters for all through
wall apartment incremental units
• Held a resident meeting, which allowed the residents to ask questions directly of the ATC
representative.
• Had ATC visually inspect 100% of the apartments that they were given access to, 406 of the
440 in the building, for dust accumulations. ATC "did not observe.,ny..dust and/or debris
