- For the COPC justification, it is impossible to pull in all of the available data that is out currently but the report will be as comprehensive as possible. The use of XRD analysis was discussed with other federal agencies and they were comfortable with the lab procedure. The clearance levels for asbestos will be based on the Asbestos Hazard and Emergency Response Act (AHERA) standards. - NYC is using the 0.01 fibers per cubic centimeter PCM clearance level, therefore, the relationship to the AHERA standard should be explained. - EPA will take the lead in developing a policy to address questions on the correlation of AHERA to other standards. There is concern about the consistency of the acceptable risk range. - We are using 10^, however, 10 ® is preferred and considered more protective. - 1 O’® is probably below background levels but we do not have that data yet. - The Working Group decided that 10 ® is not practical and will include an explanation in the COPC report. The peer reviewers recommended that a standardized approach should be used for the factors. Where this is not achievable, it will be explained in the COPC report. Mold will be explained as not being a COPC in the report.

2. Peer Review • EPA’s Regional Administrator recommends that a formal peer review process should take place. However, the Background Study and Pilot Cleaning activities should not be held up. • It is anticipated that the time needed for each project will eventually cause the projects to get into the proper alignment. If any anomalies are encountered, they will be dealt with as they occur. • The members of the Working Group will take this recommendation back to their management and will report on their support or opposition to the Working Group.

3. Pilot Cleaning • The draft SOW for the Pilot Cleaning will be shared with the Working Group, preferably before the next meeting.

4. FEMA Submission • Dore Laposta shared a draft of the scope of the EPA/NYC indoor air program that was submitted to FEMA and is being shared with all of the principals. • FEMA signed off on this version. • EPA’s Regional Counsel and the legal subgroup are currently reviewing the scope.

5. NYC and Exterior Cleaning Updates • There may only be one building whose interior has never been cleaned. • Two bids for the Indoor Air Hotline have been received and they will be opened at noon.
