THE CITY OF NEW YORK OFFICE OF THE MAYOR NEW YORK, N.Y. I0007

VINCENT A. La PADULA CHIEF OF STAFF DEPUTY MAYOR FOR OPERATIONS

October 2, 2000

Mr. Martin O'Gradv

L. .1JL. J Dear Mr. O'Grady:

I am writing in response to the document you faxed to me regarding notices of violation issued to you by the Department of Environmental Protection.

My staff contacted DEP regarding this issue. DEP informed my staff that you raised issues regarding the conduct of an inspector and that you were told that issues of that matter were within the purview of the Inspector General. As such, the matter was referred to the Inspector General of the Department of Environmental Protection, Clive Morrick, who will investigate and respond to the issues you raised.

With respect to the Environmental Control Board, I believe you know that ECB is anadministrative tribunal which adjudicates notices of violation returned to it by the City's enforcement agencies. Issues regarding ECB's policies and procedures must be directed to them. I have therefore taken the liberty of forwarding your documents to them for investigation and response as their procedures permit.

Thank you for bringing this matter to my attention.

Sincerely,

Vincent LaPadula
