JAMES F. HANLEY Commiuioner CAROLINE I. SULLIVAN SEI' U 4 2000 Flnt Deputy cnnunirslener 00-007(09 DEPUTY MAYOR OPERATIONS

Date: August 15, 2000

To: Robert M. Hardin Deputy Mayor for Economic Development and Finance

From: James F. Hanley

Subject: DEP Watershed Issues

Yesterday, representatives from my office met with Tom McWalters from Local 15, IUOE, and Torn Meyer, one of two DEP Oilers assigned to perform task$ irl various PEP facilities upstate.

DEP's Terry Joseph (Labor Relations), Charmaine Richardson. (Health and Safety) and Robert Se1ja (Test Operations and Service) also attended the meeting.

Local 15 had called to complain that mandatory training in hazardous materials and the use of respirators is being given to its members so that they may perform work on types of equipment that have been associated with mercury and.PCB contamination.

Under certain circumstances, the wearing of personal protective equipment ("PPE") such as Tyvek suits, boot coverings, gloves and approved respirators is indicated when performing work in some areas. The work itself is apparently within the employee's job specification, but the union is objecting to having to perform the work in "hazardous" conditions except on a "volunteer" basis.

The Unions representing Machinists and Electricians have been advised of the 40-bout training program which is scheduled to begin in two weeks. So far, there have been no negative reactions according to DEP.

We explained to Local 15 that the training is mandatory, and that any employee once trained and property equipped with the necessary PPE is expected to perform the duties of the job.
