Second, the program limits eligibility to leases in buildings constructed prior to January 1, 1975, a requirement imposed when the program was created to induce commercial leasing activity in older office buildings that had the highest vacancy rates. Given the current economic situation, this requirement could be updated to include a wider population of properties in the Downtown area. Under this proposal, eligibility could be extended to buildings constructed prior to January 1, 2001.
Finally, the current program does not permit tenants to receive a second "certificate of abatement" for subsequent lease renewals or new leases in the eligible area. Consequently, tenants who had been receiving CRP benefits at the time of the attack and were subsequently forced to find space in other eligible buildings in the area are no longer eligible to participate in the program. This issue can be addressed by authorizing benefits for businesses that were required to relocate to new eligible premises solely as a result of the disaster.
Based on the City's experience with the CRP, the cost of these proposed changes will be minimal in the near-term but grow to as much as $20 million annually within four to five years.
