The purpose of this letter is to request your Christopher 0. Ward cooperation in permitting DEP to perform an inspection Commissioner of the exterior surfaces of the above-referenced building. A previous inspection showed that the building exterior Robert C. Avaltroni had been impacted by residue from the collapse of the Deputy Commissioner world Trade center buildings on September 11, 2001. You &,ma of were subsequently advised of the Building Cleaning Environmental Program being conducted by DEP in lower Manhattan, but compliance did not respond. It is therefore necessary to inspect the building exterior again to determine if this Tel (718) 595-4418 residue is still present, and to collect samples for Fax(718)595-4422 laboratory analysis. Your attention is directed to ''24-106, 24-108, 24-111, and 24-608 of the Administrative Code, which authorize DEP to conduct necessary testing and sampling of potential sources of air pollution, prohibit interference with DEP personnel in the performance of their duties, and require cooperation with response measures taken by DEP to protect public health and welfare or the environment. If you do not permit the building exterior to be inspected, DEP may issue Commissioner's orders or Notices of violation which may carry penalties of up to $10,000 per day. Your anticipated cooperation is greatly appreciated.
