Trinity Church

• The DEP requirements set forth to the building owners was the performance of an assessment of visible debris. The debris is to be assessed to determine whether the material is asbestos-containing material. Any material found to contain greater than 1 % asbestos must be cleaned up by a NYS — DOL licensed contractor with NYCDEP and NYSDOL certified workers.

• The NYCDEP and USEPA performed an inspection of 74 Trinity Place on January 25, 2002, 89 Broadway on January 24, 2002, and 209-211 Broadway on January 28, 2002. These buildings are owned by Trinity Church Corporation, 74 Trinity Place, Manhattan.

• 89 Broadway and 209-211 Broadway have courtyards and cemeteries adjacent to the church building. The surveys indicated the courtyard/ cemetery of 209- 211 Broadway had the presence of visible debris due to the WTC collapse. 89 Broadway was clean of visible debris.

• Letters were mailed to the building owner requesting information on clean up activities and environmental assessments at each of the sites. In addition, a letter was sent identifying the results of the survey and the requirement to test the debris prior to any clean up activities. The subject of the letter indicated the premise where the debris was observed as 74 Trinity Place rather than 209-211 Broadway.

John Allen of Trinity Church Corp. stated during a telephone conversation that the closure of the church was based on the building owner's plan to clean the church inside and outside prior to reopening to the public. He stated he made this clear to the NY Post and DEP Public Affairs. He stated that he confirmed with the NY Post that DEP did not order the clean up. At our request he was going to call the NY Post to reconfirm this information.

• Based on this day's reports, ACP conducted an inspection at the above referenced sites to confirm the earlier findings. ACP met and spoke with Mike Borrero of Trinity Church Corp. to confirm the clean up activities at 209-211 Broadway.
