Dear Jerry,
NYC Charter Section 195 requires that a “Notice of Intent to Acquire” application be submitted
to the City Planning Commission (CPC) for authorization to acquire office or data processing
center space. Upon approval, the CPC will submit the application to the City Council for
consideration. The council has discretionary authority to review such real property acquisitions.
Enclosed for your use is an application which must be completed for the subject acquisition. Also
enclosed is a copy of a recently approved application which is partially completed and is presented
in an appropriate format.
Please pay particular attention to section #7. The attached Fair Share Criteria, Article 7 (pgs. 31-
33) should be of assistance to you.
Please return the completed application (sections 4, 6, and 7) to me at your earliest convenience.
