The draft agreement between EPA and the City states that EPA will develop, manage and implement the program for indoor air quality. It also states that EPA will provide oversight and management of the clean up and sampling contractors. The oversight and management of sampling and clean up activities will use EPA employees. DEP will sign the PW and is therefore subject to audit and is responsible for the accurate reporting of the spending of FEMA funds. It is suggested that Revenue and Claims maintain all records as they relate to expenditures and, in additon, that they implement the following process for reimbursement of all payment requests:

When the pay estimate is submitted by the contractor, it will be simutaneously submitted to DEP and to EPA for review. EPA will be required to submit a signed letter certifying that they agree with the costs as submitted or that they are deducting costs and how much of a deduction they are allowing for. The letter should state the exact amount they are signing off on.

At the same time the pay estimate is to be signed off by the DEP resident engineer, the contractor who signs form 214E and either the supervisor of the Resident Engineer and/or the Bureau Director also signs off. The estimate will be sent to Joe Terracciano via Stanley Braithwait for audit and signature. The voucher will then be prepared by Andy Moss of the ACCO's office and Andy will sign off as Departmental Certification.
