November 10,2011, and upon all the papers and proceedings heretofore had herein, the undersigned will

of that day or as soon thereafter as counsel can be heard, for an ORDER:
1. Finding and adjudging the NEW YORK CITY DEPARTMENT OF
ENVIRONMENTAL PROTECTION (“DEP”), to be in CONTEMPT of this Court for failure to comply
with a Judicially Ordered Subpoena served upon them on October 6, 2011.
2. Assessing Civil penalties against DEP and based upon said finding of contempt of Court.
3. Awarding Petitioner reasonable attorneys fees;
