Dear Council Member Koppell: Pursuant to your August 1,2013 letter to Comptroller John C. Liu, on behalf of the above-referenced constituents, concerning the property damage claims they filed in connection with the damages their respective properties sustained reportedly due to the condition of the retaining wail on Cannon Place, and my subsequent conversation with your Director of Community Affairs Andrew Sandler, I am writing to update you on the status of Ms. Hart and Mr. Rodriguez’s claims. When making determination on claims, our office must rely on Information from the claimants, foe agency being sued and other sources. Therefore, Ms. Hart and Mr. Rodriguez’s claims are under investigation pending foe agency report on the incident in question from foe Department of Environmental Protection (DEP). Consequently, foe length of time that it will take to make a determination on their claims depends on how quickly DEP responds to our request for its report. Once the claim examiner, Ms. Melanie Colman, receives foe respective report and reviews the Information contained In it, Ms. Hart and Mr. Rodriguez will be apprised of the determination made on their claims. In accordance wifo Section 50-i of the General Municipal Law, if their claims are not settled by our office within a reasonabte period of time, an action may be commenced any time after 30 days from foe filing the claim and within one year and 90 days from the date of foe occurrence. Failure to do so will render the claims null and void. Ms. Hart and Mr. Rodriguez can attain additional information about Court actions by contacting foe Bronx County Civil Court at 851 Grand Concourse, New York, NY 10451; (718) 618-1200.
