B. In the event of any violations of Athe confidentiality requirements of this

Contract by the Contractor, a-eivil-aetion may be brought against-the-Contraetor when

the violation concerns the-design, development; or operatien-ofyt-system-ef-reeerds on

individuals, and penalties may be imposed upon the officers or employees of the

Contractor when the violation eoneer-ns the operation of a system-etAeeords-on

individuals.'

.. “Qpef^tiien-of a-system of records, ” as used i n th ts-elausermeans

performance of any of the activities assoeiated-w'ith maintaining the system of

records—including the collection, use, and dissemination of records.

{^remedies may be sought under the Contract.

£1) “Record”, as used in this clause, means any item, collection, or grouping of

linformation about an individual that is maintained by an ageneyEPA, including, but

not limited to, education, financial transactions, medical history, and criminal or

employment history and thatname, address, environmental data, residential data or

other personal data, and that record contains the person’s name, or the identifying

number, symbol, or other identifying particular assigned to the individual, such as a

fingerprifttr^Fwoicepriftt-ooe^hotograph.

(^2) “System of records of individuals-records”, as used in this clause, means a

group of any records under the control of any agencvEP/\ from which information is

retrieved by the name of the individual or by some identifying number, symbol, or

other identifying particular assigned to the individual.
