12.5 EMPLOYMENT PRACTICES
Contractor and its subcontractors shall comply with the Civil Right Act of 1964 and any
amendmeni ihereto, amd the rules and regulations thereunder, and Executive Order No. 50, as
artached hereto.
12.6 INVESTIGATION CLAUSE
1.1 The parties to this agreement agree to cooperate fully and faithfully with any
investigation, avoit or inquiry conducted by a State of New York (State) or City of New York
(City) governmental agency or authority that is emposvered directly or by designation to compel

1.2 Ifany person who has been advised that his or her statement, and anry information
from such statement, will not be used against him or her in ay subsequent criminal proceeding
refuses to restify before a grand jury or other goveramental agency of authority empowered
directiy or by designation to compel the attendance of witnempes and to examine wimesses under
oath concerning the award of or performance under any transaction, agreement, lease, perrait,
contract, or license enrered into with the City, the State, or any politicat subdivision or public
authority thereof, or the Port Authority of New York and New Jersey, Or ary local development
corporation within the City, or any public benefft, corporation organized under the laws of the
State of New York, oF.
1.2(a) If any persom refuses 1o restify for a reason other than the assertion of his or her
privilege against self-incrimination in an investigation, audit or inquiry conducted by a City or
State governmental agency or authority empowered directly or by designation to compel the
attendance of witnesses and to take restimony under oath, or by the inspector General of the
governmental agency that is a parry in interest in, and is seeking restimony concerning the award
of, or performance under, any iransaction, agreement, lease, permit, contracs, or license entered
into with the City, the State, or any political subdivision thereof or any local developmeni
corporation within the City, then;
1.3 The Commissioner or agency head whose agency is a party in interest to the
transaction, submitted bid, submitted proposal, contract, lease, permit, or license shall convene
a hearing, upon not less than five (5) days written notice to the parties involved to determine if
any penalties should arach for the fallure of a person to restify.
