The contractor understands that in the event of its noncompliance with the nondiscrimination clauses of this contract or with any of such rules, reguiations, or orders, such noncompliance shall constitute 2 material breach of the contract and compliance with Chapter 13-B, EO. 50 and Rules and Regulations promuigated thereunder. After a hearing held pursuant to the rules of DLS, the Director may direct the imposition by the contracting agency head of any or all of the followmg sanctions: (i) disapproval of the contractor; (ii) suspension or termination of all or parts of the contract and/or of payments therefor; (aii) declaring the contractor in default; or fiv) in lieu of any of the foregoing sanctions, the Director may impose an employment program. The Director of DLS may recommend to the contracting agency head that a board of responsibility constituted pursuant to the Rules and Regulations of the Procurement Policy Board be convened for purposes of declaring 2 contractor who has repeatedly failed to comply with Chapter 13-B, EO. 50 and the Rules and Regulations promulgated thereunder to be nonresponsible. The contractor agrees to include the provisions of the foregomg paragraphs im every subcontract or purchase order in excess of $50,000 to which it becomes a party unless exempted by Chapter 13-B, EO. 50 and Rules and Regulations promulgated thereunder, so that such provisions will be binding upon each subcontractor or vendor. The contractor will take such actions with respect to any subcontract or purchase order es may be directed by the Director of DIS as 2 means of enforcing such Provisions inctudmg sanctions for noncompliance. comtract modifications subject to Chamer 13-B, EO. 50 and Rules and Regulations promuigated thereunder with a subcontractor who is not in compliance with the requirements of EO. 50 and Rules and Regulations promulgated thereunder. 8.2 N_BY CONTRA: R A. The Contractor shall give its personal supervision to the work or have 2 competent manager, foreman or supervisor, Satisfactory to the Commissioner assigned to the work at all times during performance of the contract, with authority to act for the Contractor. B. In the performance of the contract hereunder, the Contractor shall utilize competent and qualified persons. All such persons are the employees of the Contractor and not of the City and the Contractor shall be responsible for their acts, personal conduct and work. Cc. All services shall be performed in a skiliful and workmanlike manner.
