This is in response to your recent applications for payment. Specifically, this Christopher O. Ward addresses WTC-ARD Payment Applications 22,23, and 24. Commissioner The New York City Department of Environmental Protection has reviewed the information and has determined that in accordance with the scope of work for the project the cleaning contractor was responsible for cleaning residences, Robert C. Avaltroni Deputy Commissioner common spaces and portions of HVAC systems. Please refer to page 2 of WTC-ARD that states: Bureau of Environmental Compliance The Cleaning Contractor is responsible for cleaning residences, common spaces, and portions of HVAC systems identified by the Tel (718)595-4418 Monitoring Contractor. Fax (718) 595-4422 The cleaning of baseboard heaters in common spaces is not a separate billable item and is not reimbursable under the terms of the contract. In addition, the cleaning of “through the wall HVAC units” is not a separate or additional item and is not reimbursable under the terms of the contract.

Please be advised, the NYCDEP has discussed this matter with the USEPA and they concur with our review and determination. If you have any questions or comments, please do not hesitate to call me at (718) 595-3721.
