On or about July 3, 2001, the New York City Department of Environmental Protection Joel A. Miele Sr., RE. (DEP) became aware of the release or substantial threat of release of asbestos, a Commissioner hazardous substance, at 2418 Church Avenue, Brooklyn (Block 5104, Lot 18). Robert C. Avaltroni 2. The release or substantial threat of release of said substance into the environment Deputy Commissioner constitutes a violation of Title 24, Chapter 6 of the New York City Administrative Code Bureau of and may present an immediate and substantial danger to the public health and welfare or Environmental Compliance Tel (718)595-4418 to the environment. Under Title 24, Chapter 6 of the New York City Administrative Code, you are a “responsible person” to whom an order to implement response measures or to cooperate with and assist DEP in implementing response measures may be addressed.
THEREFORE: Pursuant to my authority under §§ 1403 and 1403(h) of the New York City Charter and §§ 24-608 and 24-610 of the New York City Administrative Code, I hereby order that you perform the work or render the cooperation or assistance specified in the attached Scope of Work.
