The New York City Department of Environmental Protections's Bureau of Air, Noise & Hazardous Materials', Division of Air/Noise, Permitting, Enforcement & Policy staff has joined in the Mayor's response to quality of life problems in various problematic locations in the five boroughs of New York. DEP has been working in conjunction with the New York Police Department, and other agencies to inspect these locations, and to ensure compliance with the appropriate sections of the noise code. The pertinent section of the New York City Noise Code in which DEP's Air/Noise inspectors enforce in the MARCH initiative is the section relating to sound production devices. According to Section 24-220 (b), no person shall use or cause to be operated any sound reproduction device for commercial purposes, wherein the sound therefore can be heard upon a public street
In addition to the revenues generated from this initiative, these violations are presented as essential pieces of evidence at State Liquor Authority Licensing hearings for such establishments, such as restaurants, bars, discos, nightclubs, etc.
