A review of the VENDEX Questionnaire submitted to DFTA and dated April 14, 1999,
disclosed that it was an Affidavit of No Change. On this affidavit, Ms. Sanchez only needed to
attest to the fact that "since the most recently submitted Questionnaire, noted above [July 11. 1997),
nothing has occurred which changed in any way, any response to that Questionnaire." Since the
document submitted to DFTA was dated April 14, 1999, Ms. Sanchez should have disclosed the
matter of her October 8, 1998 Federal misdemeanor conviction by completing a full questionnaire
in lieu of an affidavit of no change.
A review of the VENDEX Questionnaire submitted to HRA and dated June 10, 1999,
disclosed that Ms. Sanchez also indicated a negative response to Question Number 7.
This office notified the Office of the New York County District Attorney concerning the
matter of Ms. Sanchez' alleged falsification of the VENDEX Questionnaires; however, the District
Attorney decided against prosecution.
In view of the foregoing, this office is referring the above information for whatever action
you deem appropriate.
