Emerging Issues

Riverkeeper Litigation The Riverkeeper and 12 other plaintiffs filed a formal Notice of Intent to Sue on August 9. The text of the Notice is virtually identical to a previous Notice, which Riverkeeper filed as sole plaintiff on June 9th. Riverkeeper et al. allege that the City has failed to comply with significant provisions of the EPA's Filtration Avoidance Determination and the Watershed Agreement, and that any act or omission which violates the FAD must also be considered to be a violation of the National Primary Drinking Water Regulations, and thus the Safe Drinking Water Act. Riverkeeper, a signatory to the Watershed Memorandum of Agreement, has therefore broken with the provisions of that MOA, which provide for dispute resolution procedures.

Emergency Response

Water Main Break & Street Collapse - Ave N between East 105th and East 108th Streets (Brooklyn) At 6:17 a.m., Friday, August 18, DEP Central Communications received a report of a street leak in the intersection of Avenue N and East 108th Street. DEP personnel responded and found a water main break on the eight inch water main in Avenue N between East 105th and East 108th Streets (one block). Before the DEP crew arrived a NYC Sanitation truck had attempted to drive around the break; however, the roadway collapsed and the front end of the truck fell into a void that had developed under the roadway.
