Discussion of Benefits Available Under General Municipal Law Section 208(f)
For Uniformed Public Safety Employees of the New York City Police and Fire Departments who die in
the line of duty, employer-provided income
continues
to the spouse and children at a rate generally equal to or greater then that provided to the employee before death.
This is so because of General Municipal Law ("GML") Section 208(f) provides that the spouse and/or children of Uniformed Police and Fire employees killed in the line of duty are to receive a total annual benefit equal to 100% of the salary earned in the 12 months preceding death.
The 100' itself comes from the Accidental Death Benefit ("ADS') paid from POLICE or FIRE, Social Security (if applicable), workers Compensation (not applicable for New York City Police and Fire employees) with the balance being provided by GML Section 208(f).
