We are in receipt of your letter dated September 23,2003, In which you state that items billed for hi payment applications 22.23 and 24 (Baseboard Heaters and Through the Wall HVAC units) are not reimbursable under the terms of the contract.

Tetmon Co*istniction Inc. (TC1) has do argwnent with that reference or condition of the contract TCI agrees 100% that we we responsible under the terms of the contract for the completion of work as identified in the "scope of work".

TCI disagrees with your determination that *a cleaning of baseboard hems in common spaces is bwluded our base contact work. The Scope of Work A for Resit Spaces specifically ides warier section 3.r. that: "Baseboard hem will be cleaned. Protective covers o0 f led radiant beat heaters and baseboard.heaters will be removed to expose best elements. Fibs are to be brtwbted and vacuumed to remove dust." The mini um cleaning requirements for common spaces makes no mention of cleaning baseboard heaters. Although the cleaning of baseboard heaters Is included In'the cleaning of apad tents. It Is not Included in the deautag of Common Spaces. TC1 negotiated unit prices for cleaning of various HVAC cotoponents, Including baseboard hers. It is TCI's position that althou h we can be directed by the . monitoring door or EPA to clean baseboard heaters in common spaces, this Is outside the base scope of work and compensabie under the Macey negotiated unit prat
