Dear Mr. Repetto: Christopher 0. Ward Commissioner Your July 31, 2002 letter to R. Radhakri shnan has been referred to me for response. I will address your comments in the order in which Mark D. Hoffer they were made: General Counsel Bureau of Legal • it is not possible to add an A+ m indemnification/hold harmless clause to the Tel (718) 595-8556 Agreement. A claim may be filed against the city Fax(718)595.8543 in the event that any damage to the Building www.`~ ny.usf results from the cleaning work. It is anticipated that scaffolding will be removed promptly when the work is completed. DEP cannot agree that the scaffolding will be removed after a certain time period even if the work is not completed; however, the work will be scheduled in consultation with building representatives so as to minimize any inconvenience. The language contained in Article 4 (Reimbursement) is required by FEMA and may not be amended. I have attached a copy of a FEMA- approved clarification for your review. scheduling of HVAC system shutdown is a technical matter to be arranged by conference among representatives of DEP, the cleaning contractor, and the Building. The signage required by the Agreement is in accordance with relevant City Rules. in light of the foregoing, DEP must decline to agree to any revisions to the Agreement. if the building owner wishes to avail itself of the building cleaning services being offered, an authorized representative of the building owner should complete, sign and return the License Agreement. wii.nyc.gotiJdep
