On Sunday, August 4, 2002, under the direction of the DEP, the building within which I am
a tenant
(BURGER KING, 182 BROADWAY) was cleaned. The work was done to the John Street facade of
the property. A water hydrant located on the south side of John Street near the rear of the building was
used as a source of water This hydrant was defective. It leaked water underground that penetrated
the foundation well of the building. My BURGER KING restaurant occupies the entire basement and
sub-basement of my building. The water ran most of the day until your contractor realized that the
water might be coming from the hydrant. Your DEP Inspector at the site during the cleaning, also
observed the leak.
Extensive sheetrock ceiling and well was damaged. This sheetrocc k selves as a finish to the walls and
ceiling. and is also fireproofing for the wood beams it covers. Additionally, A plumber was contracted
for to help pump Out the water, and to find the source of the leak. Only after the plumber came was it
discovered that the source of the water was the hydrant. After the contractor switched hydrants, the
water ceased coming through the foundation wall.
Under the FREEDOM OF INFORMATION ACT I request a copy of the inspection report for the hydrant
in question. I have also called the telephone number you gave me to request CLAIM FORMS. I left a
voice message for someone to call me back. I could not reach a live person. if you would, please
arrange to have claim forms mailed to me at the above address.
