WHEREAS, the premises at 69 Gold Street, Manhattan were inspected by employees of the New York City Department of Health and Mental Hygiene on January 16, 2003; and

WHEREAS, such inspection disclosed the presence of damaged and friable material containing asbestos in various location/s as follows:

Corrugated paper, plaster and/or fibrous insulation materials consisting of approximately 500 linear feet in the building stairwells. Samples confirming the presence of asbestos were taken from the riser pipe insulation in stairwell A, marked #1, from riser pipe insulation in stairwell 8, marked #2, and from riser pipe insulation in stairwell A, marked #3.

WHEREAS, the presence of such asbestos-containing material constitutes a public nuisance and a condition detrimental to health in that members of the public who may be in proximity to such material may be expcsed to said material.

YOU ARE HEREBY ORDERED, pursuant to chapter 22 of the New York City Charter; Sections 17-113, 17-114, 17-141 through 17-144 and 17-158 of the New York City Administrative Code; and Section 3.11 of the New York City Health Code, to abate the above nuisance by removing all damaged fibrous type asbestos-containing material at the above locations, and all other damaged, deteriorated, and friable asbestos-containing material at the above premises in compliance with Sections 24-146.1 and 16-117 of the New York City Administrative Code, and other applicable laws and regulations; and
