GATEWAY TENANT ALERT-POTENTIAL CARCINOGENS (Gateway Plaza Apartments -200 units- 355 South End Avenue - NYC 10280)

THE DUST AND AIRBORNE PARTICLES BEING GENERATED BY THE EXTENSIVE GRINDING, DRILLING AND CHIPPING ON THE FACADE OF OUR BUILDING IS SEEPING INTO OUR APARTMENTS. GATEWAY MANAGEMENT HAS STATED IN WRITING THAT THIS WILL CONTINUE FOR OVER A YEAR.

THIS DUST MAY CONTAIN HAZARDOUS MATERIALS. OUR BUILDING WAS COVERED IN EXTREMELY HAZARDOUS DUST/PARTICULATE MATTER AFTER 9/11 AND MUCH OF THIS PENETRATED INTO THE BUILDING VENTILATION SYSTEM. IT IS POSSIBLE THAT THIS POISONOUS RESIDE WAS ALSO ABSORBED BY THE MATERIALS COMPRISING THE EXTERNAL BUILDING FACADE. IT IS NOT KNOWN IF OTHER NOW PROHIBITED HAZARDOUS MATERIALS, SUCH AS ASBESTOS, LEGAL WHEN THE BUILDING WAS CONSTRUCTED NEARLY 30 YEARS AGO ARE INVOLVED AS WELL. THE CURRENT CONSTRUCTION WORK IS RELEASING ALL THIS HAZARDOUS RESIDUE INTO THE ATMOSPHERE AND INTO OUR APARTMENTS.

THE U.S. ENVIRONMENTAL PROTECTION AGENCY AND THE NYC DEPARTMENT OF ENVIRONMENTAL PROTECTION NEED TO COLLECT AND ANALYZE AIR SAMPLES BOTH OUTSIDE AND IN OUR APARTMENTS TO DETERMINE THE EXTENT OF THE HEALTH RISK TO US SINCE ACCORDING TO GATEWAY MANAGEMENT WE WILL BE BREATHING THIS DUST IN OUR APARTMENTS FOR OVER A YEAR.

TENANTS HAVE A RIGHT TO KNOW THE HEALTH RISKS OF THIS CONSTRUCTION GENERATED DUST AND PARTICULATE MATTER. THIS WILL ONLY HAPPEN IF YOU TAKE ACTION NOW BEFORE IT IS TOO LATE. CALL THE US ENVIRONMENTAL PROTECTION AGENCY AT (212)637-S000(OR 637-3660) AND THE NYC DEPARTMENT OF ENVIRONMENTAL PROTECTION AT (212) 639-967S (or call 311), FILE AIR QUALITY COMPLAINTS AND REQUEST COPIES OF THE GOVERNMENT AGENCY AIR QUALITY TESTING RESULTS LATER WHEN COMPLETED.

THE GENERATION OF YET MORE POTENTIALLY HAZARDOUS DUST SHOULD CEASE UNTIL TENANTS ARE ASSURED BY THE ENVIRONMENTAL OFFICIALS THAT THERE IS NO HEALTH HAZARD ARISING FROM EITHER THE AIRBORNE HAZARDOUS MATERIAL PARTICLES OR FROM BREATHING CONSIDERABLE AMOUNTS OF CONCRETE DUST FOR THE ONE YEAR PERIOD SCHEDULED BY GATEWAY MANAGEMENT.
