RE: Request for Re-Inspection of Merrill Lynch Building Located at 222 Broadway (147-165 Fulton Street, 2-22 Ann Street)

Dear Ms. Theodorellys:

Merrill Lynch would like to formally request a reinspection of the exterior surfaces (roofs and setbacks) of the Merrill Lynch building located at 222 Broadway (147-165 Fulton Street, 2- 22Ann Street) prior to power washing the exterior of the building. In a document dated May 3, 2002, the NYCDEP had indicated that visible debris was identified on the exterior of the above referenced building. In response to this important issue, Merrill Lynch has implemented a comprehensive cleaning program that has ensured that all debris has been removed in a manner consistent with all public and occupational health regulations.

To assess the composition of the debris, Merrill Lynch retained the services of a New York State licensed asbestos firm to collect bulk samples on the buildings roofs, setbacks, and window sills. The results of all of the asbestos bulk sampling indicated that the majority of the debris was not asbestos containing materials (ACM) and have been attached to this letter. Although the majority of the samples did not indicate >1 % ACM, Merrill Lynch still utilized a certified asbestos handler to perform the clean up of the debris from all areas. On the two setbacks (2) that indicated debris at concentrations >1% ACM (floors 16A and 23), all necessary asbestos abatement procedures were implemented. The results of the post abatement testing air testing conducted on these setbacks are also attached at the end of this letter. All air samples indicated airborne concentrations of <0.01 fibers per cubic centimeter (f/cc)

The clean up of the debris was conducted over the course of three (3) workdays, Saturday, May 18; Sunday, May 19 and Saturday June 15, 2002. Upon completing the debris clean up on June 15, 2002, Merrill Lynch is formally requesting a reinspection of the buildings exterior so that power-washing procedures can commence.
