Dear Residents:

The Board of Directors for the 176 Broadway Owner's Corporation has determined that there are no city, state or federal agencies that are restricting access to residents who wish to re-occupy the building at this time. Each resident needs to determine for him or herself whether re-occupation is appropriate. The Board is not making any representation or recommendation, merely providing available information to residents who are now legally permitted to return.

Due to the events of September 11, 2001, the New York City Department of Buildings ordered that 176 Broadway be evacuated until further notice. The New York City Department of Buildings has since inspected the premises and determined that their requirements for re-occupancy have been met and that residents can be permitted to re- occupy provided that the building be made acceptable and habitable to the building's owners, managing agents and other appropriate governmental authorities. In accordance with standards recommended by other governmental agencies, including the New York City Department of Health, the following has been completed as of October 2, 2-001:

1. Obtained Government approval for re-occupancy. 2. Confirmed building structural integrity with John J. Flynn, F. E., who determined that the building's structure is sound. 3. All public areas have been professionally cleaned. 4. All shared building systems have been professionally cleaned and checked, including: air conditioning system, exhaust system, boiler, trash compactor, laundry machines, elevators, gas lines and water tower. 5. Essential building functions have been restored, however some residents still remain without telephone service. 6. Airtek Environmental Corp., was retained to test the air quality of the building. Ambient air sampling was conducted at various locations of 176 Broadway on September 25", 26th and 27k, 2001 as well as dust bulk sampling. Their findings, which are attached hereto, should be carefully considered by each resident in making their decision of whether or not to re- occupy their apartment. Furthermore, residents should be aware that these findings are limited to the dates that the tests were conducted and that the air quality in the building and immediate surrounding area may change each day.

The Board is working on a long term plan to address the continuing air quality and other building cleanliness issues that will arise.
