Theodore]! Penn~L_ From: Charron, William [[email protected]] Sent: Wednesday, March 05, 2003 11:54 AM To: 'Theodorellys, Penny' Cc: '[email protected]; Rose, Brad D. Subject: RE: 114 Liberty Street, Manhattan

Penny,

I spoke with Dennis Schoenrock about today's walk-through of the penthouse unit at 114 Liberty Street. I understand that the DEP's contractor announced this morning, for the first time, that it would not guarantee cleaning of appliances in the Building. This is directly contrary to what you said at last Wednesday night's meeting, when you and Mike explained quite clearly that non-pourous surfaces like the appliances could and would be cleaned, and re-cleaned if necessary, as part of the winning contractor's scope of work. We are troubled about the apparent sudden abandonment of that representation, done at the very last minute. Please explain this discrepancy in the DEP's position and statements between last Wednesday and today. Regards, Bill Charron
