15 Maiden Lane New York, NY 10038 (Respondent) WHEREAS: on September 17, 2002, the New York City Department of Environmental Protection (DEP) conducted an inspection at 18 John Street in the borough of Manhattan (the "Premises"). Based upon this inspection, it has been determined that (1) work constituting an asbestos project is being performed at the Premises; (2) said work is being performed in violation of §24- 146.1 of the New York City Air Pollution control Code ("Code") or the New York City Asbestos Rules ("Rules") promulgated thereunder; and (3) the work poses a threat to public safety. THEREFORE: Pursuant to my authority under §24-146.1(h) of the Code, I hereby order the following: 1. That the above-named respondent immediately stop work at the Premises, and immediately take all necessarysteps to ensure that all work by any persons at the Premises is immediately stopped. 2. work may not resume until a written scope of work is received and approved by DEP. Approval of the scope of work by DEP shall rescind this order. The scope of work shall be submitted to DEP by fax at 718-595-3749 or in person during regular business hours at 59-17 Junction Boulevard, Corona, NY, 8th floor. VIOLATION OF THIS ORDER MAY RESULT IN THE ISSUANCE OF A NOTICE OF VIOLATION AND THE IMPOSITION OF A CIVIL PENALTY OF UP TO TEN THOUSAND DOLLARS PER DAY.

THIS ORDER TO STOP WORK SHALL BE SERVED UPON THE NAMED RESPONDENT, OR AT THE PREMISES UPON THE OWNER, LESSEE OR OCCUPANT OF THE PROPERTY, OR TO THE AGENT OF ANY OF THEM, OR TO ANY PERSON OR PERSONS PERFORMING THE WORK. Christopher 0. ward, Commissioner, NYC Dept. of Environmental Protection, by
