This is a follow-up to our communications with regard to the exterior clean-up activities at 93 Nassau Street, also known as 139 Fulton Street, Manhattan. Christopher O. Ward Commissioner As you are aware, DEP has been acting as an intermediate between your building and the Federal Emergency Management Agency in an attempt to provide 93 Nassau Street with a possible alternative to the Exterior Clean-Up program being Robert C. Tel (718) 595-4418 An enormous effort was made on your behalf by DEP and FEMA, however, the Fax (718) 595-4422 scope of work developed for the Exterior Clean-Up Program cannot be changed to accommodate the pre-existing condition of your building.

Additionally, according to FEMA's review of your building insurance records, your insurance company paid monies to you for a clean up. You are responsible for your building and must undertake a clean up of your exterior at the earliest date possible. DEP will expedite any filing that may be required to undertake this clean up and assist in any manner possible. The DEP has already reached out to the New York City Landmarks Commission and the New York City Department of Transportation and will provide you with contact information. Please be advised that failure to undertake the necessary clean-up may result in the issuance of a Commissioner Order for a clean-up and may result in penalties. Your assistance and resolution of this matter is greatly appreciated.
