(B).___ In the event Landlord (i)^ails to commence construction of the Work within
ten (10) business days after its receipt of Tenant's approval of the Tenant’s Work CosPe^imate
and/or pursue completion of same diligently and in continuous manner, and/or (ii) fails to meet
any applicable time frames under Subsection (A) above, then Tenant 'shall give Landlord written
notice (hereinafter referred to as “Delay Notice”) advising I.'andlord of its failure to so commence
and/or perform. If Landlord fails to commence the work or perform its obligations under
Subsection (A) above within ten (10) days from the date of said notice, Tenant, in addition to any z
other remedy it may have, at it's option may ; (i) as agent of the Landlord commence performance
of the work and deduct the odst thereof from the rent to become due and payable pursuant to
Article 2 hereof and/or Tenant’s share of Tenant’s Work Cost; or (ii) terminate this Lease on ten
(10) days written notice to Landlord. Tenant, however, shall not be required to exercise either of
the foregoing rights. If Tenant elects not to terminate the Lease, and regardless of whether or not
