The New York City Department of Environmental Protection (DEP) has reviewed the risk management plan submitted by your facility pursuant to section 24-718 of the MARILYN GELBER Commissioner administrative code of the City of New York. DEP has determined that your facility's risk management plan complies with the minimum requirements for preparing such plans contained in section 24-718 of the administrative code and Title 15 RCNY 41-01 et seq. The New York City Fire Department has concluded its review of the Emergency Response Program section of the Risk Management Plan. Accordingly, with this letter DEP formally approves your facility's risk management plan.

Please be advised that this approval in no way affects your facility's responsibility to prevent the release of any extremely hazardous or regulated toxic substance, nor does it serve to limit your facility's liability for the consequenc.;.s resulting from such release. DEP by virtue of reviewing and approving your facility's risk management plan has assumed no liability whatsoever for the proper storage, use, and control of any extremely hazardous or regulated toxic substance or for the accidental release of such substances.
