53. Deny the allegations set forth in paragraph “94” of the complaint, except
admit that defendant Coyle prepared an “Immediate Emergency Declaration” form, dated
November 26, 2007, which recommended that the house at the subject property be demolished,
that the recommendation was approved by the Administrative Chief Inspector and Borough
Commissioner on that date, and that DOB Deputy Commissioner Amer sent a Memorandum to
defendant Mustaciuolo of HPD.
54. Deny the allegations set forth in paragraph “95” of the complaint, except
adfnit that on December 6, 2007, DOB Inspector DeLuca conducted'an other inspection of the
subject property and issued a second “Immediate Emergency Declaration” with respect to the
garage on the subject property, and that DOB Deputy Commissioner Amer sent a Memorandum
to Defendant Mustaciuolo on December 7, 2007.
55. Deny the allegations set forth in paragraph “96” of the complaint.
56. Deny knowledge or information sufficient to form a belief as to the truth of
the allegations set forth in paragraph “97” of the complaint.
57. Deny the allegations set forth in paragraph “98” of the complaint.
58. Deny the allegations set forth in paragraphs “99,” “100,” “101,” “102,”
“103,” and “104” of the complaint, except admit that someone brought a copy of the signed
Order to Show Cause to the subject property at the time of the demolition.

“109,” and “110” of the complaint.
60. Deny the allegations set forth in paragraph “111” of the complaint, except
admit that HPD forwarded a notice, dated November 27, 2007 to plaintiff, and respectfully refer
the Court to a copy of the notice for its complete text and true content.
