MEMORANDUM Department of Environmental Protection TO: Robert Avaltroni 59-17 Junction Boulevard Mike Gilsenan Corona, New York 11368-5107 Judah Prero

FROM: Mark D. Hoffer Joel A. Miele Sr., P.E. Commissioner DATE: 1/24/02

Mark D. Hoffer RE: Release of Vehicles Taken from Ground Zero Area General Counsel to Fresh Kills by the FBI for Investigative Purposes Bureau of Legal Affairs Tel (718)595-6555 The FBI is planning to release certain vehicles taken from the Fax (718) 595-6543 www.ci.nyc.ny.us/dep vicinity of Ground Zero to the Fresh Kills landfill for investigative purposes (apparently, certain insurance companies and owners have made requests for the return of the vehicles).

Attached is a copy of a memo I just received from Steve Levi at the Law Department, explaining this, along with a copy of a letter from the FBI, forwarding the results of certain tests on the vehicles conducted by the federal government.

I would appreciate Bob having appropriate Air/Haz Mat staff review the report, and provide any comments/concerns to Judah, who should then transmit them to OEM (Attention OEM’s General Counsel, Lai Sun Yee). Note the deadline is Monday, 1/28 at noon (they didn’t give us much time for this).

Thanks for your help on this.
