3. Implementation of Federal assistance pursuant to Section 422 of the Stafford .Act. Simplified Procedure? whi'ch govern ^•malP^pi^jects in the FE.MA Public .Assistance program less than or equal to 850,600 when it has the effect of restoring a facility to its pre-disasler condition using in-kind materials and workmanship.

C. FEM.A will determine when an Undertaking involves a non-historic property in the Impacted .Mea by consulting .Appendix C. Non-historic properties include any propertie.s within the Impacted .Awa that are not listed in .Appendi.x C. If an Llndertaking affects only a non-historic property within the Impacted Area and does not involve ground- disturbing activities. FEM.A will document thisMfetermination in the project file and authorize the release of funding for the Undertaking.

D. FEM.A will determine when an Undertaking meet.s applicable criteria of the Programmatic .MIowances (.Allowances) listed in Appendix .A. FEM.A will document this determination in the project file and authorize the release of funding for the Undertaking. FEM.A and the SHPO may agree upon modification or additional allowances to .Appendix A upon mutual written consent, without necessitating amendment!? to this agreement.

E. For all other actiA'ities, FEM.A will conduct Section 106 review in accordance with Stipulation IV. or W of the Agreement.

III. GENERAL

A. Professional Qualifications: FEM.A will use Federal. New York State agency, or contractor staff who meet the Secretary of the Interior's (SOFs) Professional Qualifications Standards (Qualifications). as determined by FEM.A's Federal Preser\ ation Officer (FPO), in the required disciplines, in ensuring compliance with thi.s .Agreement.

B. Review Periods: .All time designations wilt be in calendar days. If any signatory does not comment on a determination related to a proposed action within an agreed upon timeframe. FEM.A may assume the signatory'.s concutrence with FE.MA's determination.

C. Information and Consultation: SEMO and FEM.A as appropriate, will pro\ ide information related to the Section 106 review process to all applicants. FEM.A will provide concurrent notice to the City of New York's Landmarks Presen ation Commission (EPC) for Undertakings which require SHPO consultation related to the Programs, and consider any views which the EPC provides within seven days of the notification.
