Dear Mr. Millman:

On August 24, 2000, the Department of Health (DOH) resubmitted a contract with East Harlem Council for Human Services, Inc. (East Harlem Council) for registration. The original request for registration had been withdratvn by the Mayor's Office on August 23, 2000 in response to unanswered concerns raised by this office. The contract, which is approximately S I million, is for case management for vendors providing services under the Asthma Critical Event Response System program.

High levels of asthma in East Harlem and other areas of the City is a very serious issue. We have previously communicated our concerns about the delays in implementing contracts essential to the remediation of this problem. In a September 10, 1999 letter to DOH, we wrote regarding its extensive delays in awarding other Asthma Initiative contracts for an RFP that was issued in 1998 (see attached). In spite of our letter and the continued high asthma rates in parts of the City, those contracts were only recently submitted for registration - almost two years after issuance of the RFP.

Upon review, we found that the East Harlem Council contract suffered protracted delays similar to those described above. This contract was let by Negotiated Acquisition, a less competitive method of procurement designed to accelerate the award of the contract due to "time sensitive " circumstances. In spite of the necessity to quickly implement this asthma initiative and the diminished competition, it has been 15 months since the solicitation was announced and 1 year since East Harlem was chosen as the contractor.
