positions with Tenant's own employees, as long as employees are
qualified to monitor Class E system and elevator security, and no
labor problems are caused.
Executive and general offices and related ancillary purposes of the
USE:
(Art. 10.1(a), Pg. 89) headquarters' staff of the Human Resources Administration or other
use as the Commissioner of the Department of Citywide
Administration may determine.
ALTERATIONS: Landlord's consent required (except for decorative alterations under
(Art. 11, Pg. 97) $50,000 such as painting, decorating and/or wall covering), not to
be unreasonably withheld for non-material alterations. Tenant shall
pay to Landlord Landlord's reasonable out-of-pocket costs and
expenses for reviewing plans and specifications and inspecting
alterations. Tenant entitled to one floor cut per floor for internal
staircase.
REPAIRS: Landlord to make all structural repairs and replacements to the land
(Art. 13, Pg. 105) and building. Tenant to maintain, make improvements, repairs and
replacements to the premises.
ADA: Landlord will cause common areas to comply with ADA, but will
(Art. 18, Pg. 119) not be responsible for providing elevator or escalator access or
toilet service to Mezzanine or Basement. Tenant is responsible for
ADA compliance in the premises and in common areas as a result of
Tenant's particular use.
HOLDOVER: Tenant shall become a month-to-month Tenant at a monthly rental
(Art. 20, Pg. 125) equal to all Additional Rent plus 1) 150% of Base Rent for first 60
days of holdover period and 2) 175% of Base Rent thereafter.
NOTICES: Certified mail, return receipt requested, or overnight courier.
